The information presented below has been derived per bnature’s understanding of the information provided on the Supreme Council for Environment website regarding the Management of Hazardous Chemicals service, as well as the experiences of members of bnature’s community in applying for a chemicals licence. Please refer to the SCE website for more details.

How to apply for a chemical licence in bahrain

In order to purchase, use, store and/or handle chemicals in the Kingdom of Bahrain, a chemical licence must be obtained from the national environmental regulatory body.There are three types of chemical licence that are issued by the Supreme Council for Environment (SCE)

  1. Licence to purchase, use, store and handle chemicals
  2. Licence to expand the list of chemicals being purchased and
  3. Licence to import and export chemicals 

NOTE:

    • The SCE regulates chemicals that are classified as pure and/or restricted chemicals, all other chemicals that do not fall under this umbrella do not require a permit. There is no official list that outlines the permitted and/or restricted chemicals and hence, applicants are encouraged to contact the Chemical Unit at the SCE to enquire regarding their chemical interest. 
    • Licence to purchase, use, store and handle chemicals must be renewed on an annual basis.
    • Some chemicals require a licence from more than one regulatory body. For example, when applying for a permit to purchase and use Hydrochloric Acid (HCl) and/or Acetone, the SCE will grant a “No Objection” notice whereas the permit will be  issued by the Ministry of Health (MoH). This is due to some chemicals being classified as precursor substances.

Application process to purchase, store & handle chemicals

  1. An official letter requesting to purchase, store and handle chemicals must be submitted by the applicant to the Head of Environmental Licensing Section at the SCE.
  2. Fill and complete the chemical application form which must be sent in an excel format (SCE Chemical Application Form.xlsx). 
  3. Submit the Material Safety Data Sheets (MSDS) for each chemical substance necessarily containing a chemical composition of 100% should be attached to the application form.
  4. Copy of the Commercial Registration Certificate of the Applicant including CR’s activity enabling the importation of chemical materials.

The completed application must be submitted via email to the SCE Chemical Unit (chemicals@sce.gov.bh).

  1. Following the application submission, the applicant may not always receive a confirmation email with an application reference number from the SCE, however, it is encouraged to follow up on the application via the SCE Chemical Unit’s contact information.
  2. Once the application has successfully passed through the review process, the applicant will received an electronic invoice from the SCE which must be paid as part of the new law issued in May 2021 i.e. Decision No. (4) of 2021 | Concerning the Fee Categories for all Licensing & Services Fees provided by the Supreme Council for Environment which entails that all environmental licensing applications including those related to chemical licensing will now be subjected to a fee.
  3. Following confirmation of the payment, the SCE shall issue the required licence. 
  4. Once the licence has been granted, the applicant may proceed towards purchasing, storing and handling chemicals as appropriate.

Application process to obtain a permit from the ministry of health (mOh)

Following the issuance of a chemical licence from the SCE, the licence might indicate that for certain chemicals, the SCE approval granted for the intended chemical is of “No Objection”, subject to Ministry of Health (MoH) permit. This will be the case for chemicals classified as precursor substances e.g. Hydrochloric Acid (HCl) and/or Acetone whereby a permit from MoH must be obtained. Based on recent procedure rules, MoH requires the CR holder (i.e. the applicant) to submit a safety certificate from the General Directorate of Civil Defense which is under the Ministry of Interior

 

NOTE:

To obtain a permit from the Ministry of Health (MoH), there are two routes that can be taken:

 

  1. Local chemical suppliers (such as Concord International and TechnoChem) are authorised to apply for a licence from MoH on behalf of the applicant. 
  2. Alternatively, an application can be made directly to MoH via email (chemicalmoh@sce.gov.bh).  Once a permit has been obtained, it would be valid for 6 months and only for the quantity required/applied for.

To apply for a permit from MoH, whether directly or via a local chemical supplier, the applicant must submit and include the following documents:

  1. Completed “Precursor Purchase Licence (PPL) Form” (MOH PPL Form.pdf) along with the applicable documents mentioned in the bottom of the form.
    NB: In the PPL Form:
  • Original stock refers to the quantity the applicant purchased or received previously in addition to the quantity still in stock at the applicant’s premises at the date of receiving.
  • Stock on hand refers to the quantity the applicant has presently in its stores and the quantity consumed (i.e., original stock minus stock on hand).


The PPL Form must be signed & stamped

  1. Copy of the CR Certificate
  2. Issued SCE Chemical Licence
  3. Provide information regarding what will the chemical be used for
  4. Provide information regarding where the chemical will purchased from (i.e. local supplier)
  5. A licence application must be made for each chemical substance requested separately e.g. one application for HCl and one application for Acetone.
  6. The stock movement record form ( MOH Stock Movement Record.pdf) for each of the chemicals must be updated with each request.
    1. Following the application submission, the applicant may not always receive a confirmation email with an application reference number from the MoH, it is therefore encouraged to follow up on the application via the provided MoH contact information.
    2. Once the application has successfully passed through the review process, the applicant will receive an electronic invoice from the MoH.
    3. Following confirmation of the payment, the MoH shall issue the required licence. 
    4. Once the licence has been granted, the applicant may proceed towards purchasing, storing and handling the intended chemical.

NOTES:

  • Each licence is valid for use within 6 months only.
  • The licence is valid for one purchase only or multiple purchases which amount in total to the quantity listed in the licence. For example, if the licence is granted for the purchase of 1L of HCL, then, the 1L of HCL may be purchased at one time or 500 ml may be purchased twice within 6 months or 250 ml may be purchased 4 times within 6 months.

  • The MoH requires the applicant to submit a quarterly report of its “Stock Movement” (MOH Quarter Report Letter.pdf) which details its chemical usage including incoming, supplied and remaining quantities. Based on the Law No. (15) of 2007, Article (29) dictates that all those who hold a licence to import, export, possess or deal with precursor substances must send two signed and stamped copies of the “Stock Movement Form” to the concerned authority in the Ministry of Health in the first week of every three months (https://www.legalaffairs.gov.bh/PDF/K1507.pdf or https://www.legalaffairs.gov.bh/HTM/K1507.htm – ( Law15_07.pdf)

Application process to obtain licence and customs clearance procedures for banned and severely restricted chemical materials

  1. Complete the banned or severely restricted substances form (obtain form from SCE). 
  2. Submission of a valid chemical licence issued by the SCE to the applicant permitting the addition of new chemical materials for import, export or use (i.e. purchase, storage, handling and use) of chemicals.
  3. The applicant must submit the above documents through the customs clearance system (i.e. the Bahrain Horizon Portal also known as Ofoq: http://www.ofoq.gov.bh ).
  4. Copy of the Commercial Registration Certificate of the Applicant including CR’s activity enabling the importation of chemical materials.
  1. Following the application submission, the applicant will receive a confirmation email with an application reference number from the Customs Clearance System.
  2. Once the application has successfully passed through the review process, the applicant will receive an electronic invoice from the SCE which must be paid as part of the new law issued in May 2021 i.e. Decision No. (4) of 2021 | Concerning the Fee Categories for all Licensing & Services Fees provided by the Supreme Council for Environment which entails that all environmental licensing applications including those related to chemical licensing will now be subjected to a fee.
  3. Following confirmation of the payment, the SCE shall issue the required licence. 
  4. Once the application has been approved, the applicant is entitled to proceed towards importing the desired chemicals. 

NOTE:

The applicant (i.e. chemical importer) will be held legally accountable in case of violation of the chemical import terms and conditions provided by the SCE as part of the licensing permit.
